Maybe someone can explain this to me..

It clearly wasn't Scott's fault, and its the other party who will be paying all damages.. Why do they get to decide if it is a write off or not? Is Scott not reasonably allowed to demand that his car is fixed? Or is the calculation based on the value of the car which Scott declared on his insurance?

I've not been in an accident myself, touch wood, but if I was and it wasn't my fault, I would like to think I have some grounds to refuse them just writing if off?

If I'm spouting BS please correct me someone :-)

If the cost to fix is more than value of the car then it will be a write off.

Beyond economical or financial repair.

An tbh with price of the parts it will be stupid.

Bonnet, wing, bumper, headlight, foglight all from pug. Then spraying and labour. They just write it off. But Scott could buy back and fix it himself cheaply Wink

Can you contest their calculations though?

You could fix that cheap through a breakers, or expensively through a dealer?

He does have a point though matt, if its not your fault and if you wanted to you can demand that you are put back in the position that you were in before the accident regardless of cost, be that repairing your car or replacing it with an equal car (same make, mileage, condition etc) even if the car is deemed uneconomical to repair as far as I understand it!

You can argue it. Say Scott's car is worth £1.50 (accurate estimate there) and it will cost £2.00 to repair. The insurance will automatically try to write it off and offer you £1.50 to buy a new one.
You can either let them write it off but argue the payment they give yo (for instance, Scott's car was an immaculate example and won't get one the same for £1.50) or you can get them to repair it for £2.00 once again saying it was in perfect condition.

They have to put you back in the position you were in before the accident.

Does the opposing company then have grounds to say:

"Well if its so valuable, why did you only declare it as being worth £xxx"?

No because the value you declare mean bugger all really.

If I told the insurance my car was 10k worth, and I had an accident, they wouldn't pay out 10k

Tbh I didn't even think of it like that! If I was Scott I'd be demanding another v6 in minty fresh condition Wink

I somehow don't think Scott is going to ask for it to be repaired, considering he was looking at selling it! With the money he could get if it is a write off, he'd be able to get a car that isn't a grandad car, V6 or not!

I think demanding the car to be repaired all depends on what car it is and how much you like it. If it was my Corsa for example, I'd just let them write it off, take the money and get a new one. If it's a shiny 6 Smile I'd be wanting it repaired!

I guessed this much, I was just pointing out that if its not your fault then the car doesn't have to be written off because its uneconomical to repair Smile

Have you seen how expensive a new 406 Coupé bumper costs? (insurers have to base costs of repairs on replacement - new - parts)

She would only have needed to glance off your front bumper to write the car off, such is the value of the 406 Coupé nowadays. Repairs for that will run up a bill of around £3k I reckon, at least.

Time to buy something sportier...

Women driver.

Corsa.

It was an accident waiting to happen IMO.

Anyway I reckon bumper, bonnet, headlight, wing, few bits of plastic, plus labour, paint and a hire car I reckon you might be lucky and get money for a GTi6 (or GTiV6 ninja)

Thing is, we don't know if the radiator has an issue, as there's fluid all over the floor/ she hit one of the pipes. Also, he hasn't checked the wheels or the chassis to see if they've been damaged (considering she pushed the car back a good 5 foot!). So there's a potential it could be more?

You could demand it but it would be both detrimental to your future insurance costs and you'd be almost as bad as those who claim whiplash for minor accidents wanting to repair a 10-year-old Peugeot lol

Anyway, the headlights are discontinued so you'd be f*cked anyway.

Claiming for whiplash when you don't actually have anything wrong with you and having a car that has been f*cked by someone else put back how it was before the accident are slightly different I feel!

As he is not at fault it wouldn't make any difference to insurance other than the addition to your premium for your car being involved in an accident which will happen anyway whatever the result!
