True, but most people (the average driver) books their car in for a service and MOT together (doesn't matter how far you drive it in a year, once a year is what is needs apparently

Thing is they'd probably realise he's trying to get around getting an MOT on it by using that rule.
Safer option: Get the seller to put an MOT on it, and pay extra if necessary.
