As long as he hasn't filled out his details on the green slip you can send it off saying the previous owner musnt of sent off the V5 and can you have a new one and then you dont have to pay
Take extra precautions when you buy in case it goes bent.
Double check the car matches the spec it should be and that all the ID numbers and age identifiers are correct and look unaltered.
Get full details off the bloke and tell him your doing it in case the car turns out to be stolen or a ringer, great way to see if hes dodgy cos he will react badly if hes scamming you. Ask for his driving licence to copy his driver number off and the address (if you can mentally cop that the pic is defo him and remember his date of birth.) write down yourself any details he tells you about himself including his nans address, the car he turns up in, his phone number and such like.
Oh and get a full signed receipt
